side of this fight. >> jenelle is here with all the developments. >> those oral arguments started up about an hour ago and there is a large demonstration outside the courthouse. police are there in front of the courthouse. it is dissipating a little bit. the protestors are basically against arizona's immigration law which gives police the authority to stop anyone they have reason to suspect may be in the country illegally. but within months the obama administration brought it to court and the judge issued an injunction putting a big portion of the law on hold. they will decide whether to lift that injunction. >> the problem of drug and human trafficking has grown to epic proportion so it passed a law to require police to check the legal status of anyone they lawfully pull over. the federal government is failing on the issue of illegal i immigration so it took matters into its own hands. >> the fact that the

administration won't enforce what congress says doesn't mean that arizona should have to bear the brunt of it. >> this morning arizona presented its arguments before a three-judge panel. it opens the door to the racial profiles of latinos. dozens marched through the streets of san francisco all the way to the courthouse. the obama administration is also opposed to the law saying the state is stepping on its toes when it comes to regulating immigration. >> one of theadoptions of the constitution was a concern individual states might embroil the entire nation in disputes with other countries. >> the three-judge panel including an appointee of ronald reagan and carlos, a george w. bush acquaintee who said he was almost wrongfully deported years

ago. abc 7 legal analyst dean johnson believes otherwise. >> judges nunnen and baya are on the conservative 9th circuit. because of that they would tend to give a little more flexibility, a little more leeway to the states in regulating immigration policy. >> arizona's governor janet bruno who signed the law this past april flew in just to attend the hearing. she will fly back to arizona to continue her election campaign for governor. election day is tomorrow. they expect to give the decision the coming weeks and months. it's expected to go up to the u.s. supreme court. >> in san francisco a three-year-old girl is in serious condition after a shooting. she and her grandfather were innocent victims. it started at the home from trick or treating. gunfire happened about 10:00 last night at 25th street and

connecticut hill neighborhood. she was shot several times. her grandfather tried to shield the little girl with his body and he was hit once in the leg. another man was hit several times. the shooting appears to be gang-related. >> the driver of a big rig is dead after a fiery crash in vallejo this morning. the big rig was traveling on westbound 80 when he exited on columbus parkway. he failed to negotiate a curve, hit an embankment and caught fire. police closed access to columbus and westbound 80 for several hours which caused a big backup during the morning commute. >> the election now, the final push underway among the candidates. jerry brown wraps up in oakland. meg whitman held her last rally in menlo park this morning. terry? >> about 100 very enthusiastic

meg whitman supporters gathered to see their candidate in menlo park. she stays and they are anxious to agree with her, that the polls are wrong. that tomorrow night we're going to be finding out california has elected its first female governor. pleasantly surprised. terry mcsweeney. >> thank you. the san mateo county sheriff's department is formally taking over the carlos police department. 43 police employees are being sworn in as new members of the sheriff's office. the santa clara city was offered a position with the sheriff's department. it will be used as a sheriff's substation. san carlos is investigating the agency. >> a fire broke out about 2:30 in the morning inside the savoy cafe. it quickly spread to a recycling center next-door. both buildings were gutted. damage is estimated at more than $2 million. >> most of it started to the rear. you can see to the front area, you can still see things that

aren't burned to the ground but destroyed to the back. the roofs are all open. >> fire officials aren't saying the fire is suspicious but fire investigators are at the scene. four other fires have been set in the that area the last 24 hours. nobody was injured. >> giants fans are hoping today will be the day that san francisco captures its first ever world series title after an amazing win last night. for the first and only time in this area fans can watch the game for free live on jumbotron. officials are setting up the big screens and seats for game five, hopefully the clincher. outside the rangers ballpark in texas, shu. >> kristen, it has been so exciting. as you mentioned one game away from bringing home the first ever world series in baseball in san francisco. let me show you how they did it real quick.

62,000 fans on hand last night to soak in game four. it was scoreless until aubrey, his first postseason home run off tommy hunter. the giants went up 2-0 and it was all support but madison baumgartner wouldn't need it. shutout ball and the giants go on to win it 4-0 to take a 3-1 series lead with the 21-year-old rookie's victory, i thought to myself let's talk to some giants fans about what it would mean to bring a championship to san francisco. so pretty straightforward for the early part of this week. going to be sunny, quiet weather today. warming trend, kind of peak around the midweek and high pressure will release its grip. a cold front and that will bring us a cooler weekend and small chance of showers but nothing like we've dealt with the last couple weekends. not a game-changer or a plan-changer. santa rosa about 1 degree warmer than average. concord and redwood city, too. oakland, 8 degrees above average today. this is just the beginning of the warming trend. low to mid-70s the south bay with campbell the warm spot at 75. 69 sacramento. everybody else the low to mid-70s. on the beaches, sunshine today and mid-60s for you. watch for rough surf tomorrow. petaluma, everybody else the low to mid-70s.

robbing an 80-year-old woman of her purse and dog. 2:00 saturday the woman was walking her dog deuce on fountain street when the suspects approached her and denanded her purse and dog. he has a microchip implant that can be used to identify him. the suspect's description is vague. they drove away in a faded honda or toyota sedan with a primer colored left front corner panel. >> health news, a possible new approach to fighting parkinson's disease. researchers say the disease may stem from an energy crisis in the brain years before sean symptoms appear. they believe giving a boost to a brain switch or power switch may slow parkinson's progression. parkinson's patients have tremors as this gets more severe as they lose brain cells and lose muscle movement. >> athletes of all ages suspected of suffering a
